Keuka Street man charged with DWI, .31% BAC
12/4/2011 - With the highest BAC I have ever seen, Penn Yan Police arrested Daniel P. Wolf, 23, of Keuka Street, Penn Yan after a vehicle stop on Liberty Street at 1:35am. Wolf’s vehicle was observed traveling south on Liberty Street where he failed to keep right. He did have an odor of alcoholic beverage on his person. He was given several field sobriety test and was found to be intoxicated. Wolf was placed under arrest and taken to the Yates County Public Safety Building for a breath test that showed to be .31% BAC. He was given tickets for failure to keep right, DWI, and aggravated DWI. Wolf will appear in village court on 12/19/2011.
Trespasser passed out in basement
12/4/2011 - Michael J. Labadee, 27, of Leech Rd., Penn Yan was arrested for 2nd degree criminal trespass after a complaint from a village resident that he entered the basement of her apartment without permission. Officers located Labadee passed out inside the basement. He was issued an appearance ticket for a later date in village court.
New drug store to open in Rushville
12/5/2011 - Per the village of Rushville’s clerk and many locals there will be a new drug store located at 2 South Main Street where the old Antique Shop was on the corner of Gilbert Street. Construction has already started on the inside. Residents’s state that the owner of the store to be is Ray Gignac, who has a few other drug stores in the Rochester area. It will be privately owned and not a chain pharmacy. A call has been made to Mr Gignac to see when the opening day might possibly be. For the residents of Potter, Middlesex, Rushville and the many other small hamlets in the area a drug store in Rushville is a great addition since it is 12 miles to Canandaigua or Penn Yan.
New re-chargeable battery law is in effect
12/5/2011 -The NY State Rechargeable Battery Law, originally enacted as Chapter 562 of the Laws of 2010, requires retailers to accept from consumers at any time during normal business hours rechargeable batteries of a similar size and shape as the retailer offers for sale. Manufacturers of rechargeable batteries are responsible for advertising the program to consumers, and must finance the safe collection, transport, and recycling of these batteries collected by the retailers. Manufacturers must submit plans for approval by NY State Dept of Environmental Conservation, and comply with regular reporting requirements. Starting December 5, 2011, rechargeable batteries were also banned from disposal throughout NY State.
This law is written to work in conjunction with Call2Recycle , a free rechargeable battery and cell phone collection program that is operated by the Rechargeable Battery Recycling Corporation (RBRC), a non-profit organization.
MVA on Dundee-Starkey Rd.
At about 3:00pm the Yates County 911 Center dispatched the Dundee fire and ambulance crews to a reported one car roll over motor vehicle accident at the intersection of the Dundee - Starkey Rd and Sample Rd. Everyone was reported out of the vehicle and not injured.
4 year old injured in Glenora farm accident
12/5/2011 GLENORA - At about 5:20pm the Yates County 911 Center called out the Dundee Ambulance to 639 South Glenora Rd. for a report that a 5 year old that was injured when lodged between a wagon and a skid steer. It was reported that the youth was taken inside and did suffer a serious head injury. Mercy Flight was first placed on standby then the Dundee Fire Department was dispatched to set up a landing zone for Mercy Flight.
Per NY State Police reports a 4 year old was on the back of farm equipment, on the family farm, located at 639 South Glenora Road, when the equipment was struck by another piece of farm equipment. His father was sitting in second piece of farm equipment when it rolled towards the first piece striking it causing the injury. The father stated that both pieces of equipment were not running at the time of the accident. The father of the 4 year old immediately called 911. EMS and State Police responded and the 4 year old was taken to Schuyler Hospital for a reported head injury and was then airlifted to Upstate Hospital in Syracuse.
The investigation is ongoing at this time.

Long time Potter Center resident, Etheleen Hey dies
POTTER CENTER - Etheleen S. Hey, age 91, died on Saturday, Dec. 3, 2011. Friends may call on Thursday, December 8, from 2 to 4 p.m. and 7 to 9 p.m. at Kenneth J. Perkins Funeral Home, 2583 E. Main St., Gorham. A funeral service will be held on Friday, December 9, at 11 a.m. at the funeral home. Burial will be in Shuman Cemetery. Memorial contributions may be made to Potter Baptist Church, c/o Lois Artlip, 536 W. Swamp Road, Middlesex, NY 14507. Etheleen was the daughter of the late Murray and Gladys Santee Savage. She worked as a clerk at the old Flynt’s General Store in Potter. She was a member of the Potter Baptist Church and its Ladie’s Aid Missionary Society. She enjoyed crocheting and crafts. Etheleen is survived by her daughter, Kristine (Perry) Mize of Texas; son, Ron (Joyce) Hey of Naples; three grandchildren, Tessa (Todd) Conaway, Cassie (Christopher) Ryder and Leanne (Jamaa) Coleman; four great-grandchildren, Tucker Ryder and Brie, Austin and Sean Conaway; sisters-in-law, Doris Hey, Lois Hey and Frieda Burcroff; and several nieces and nephews. Etheleen was predeceased by her husband, Clyde Hey, in 1994.
Tractor fire on Toomey Rd.
12/6/2011 - At about 5:10pm the Yates County 911 Center dispatched the Bellona Fire Department to a tractor fire at 1720 Toomey Rd. near the Coleman Rd. in the town of Benton. The tractor was reportedly 10 feet from a barn. The Bellona Fire Dept. and the Penn Yan Fire Dept. were both called for mutual aid as well as a tanker out of West Lake Rd. The fire was reported knocked down at about 5:40pm.

Landmark Wine and Spirits burglarized
12/7/2011 - Penn Yan Police are investigating a burglary to the Landmark Wine and Spirits store that occurred sometime during the evening of overnight hours of November 30th. During the break in the cash register was taken along with cash and liquor from the store. Police are asking for assistance from anyone that may have seen anything or that may have other information pertaining to the burglary. The public can call Inv. There is a $500.00 reward being offered for information leading to the arrest and conviction of the responsible parties.

Potter roads slippery, several accidents
12/9/2011 - As highway crews were out sanding the roads this morning it seems not to have been soon enough for some motorist in the town of Potter. A combination of over night fine snow, the perfect temperature and a slight fog led to numerous motor vehicles sliding off the road, one rolling over. At about 7:50am the Yates County 911 Center dispatched the Rushville and Middlesex fire departments and Middlesex Ambulance to State Rt. 247 and Dunton Rd. for a one car MVA. At Ferguson's Corners Rd. near the Potter Muck a van slid off the road and onto it’s side. At about 8:30am the Gorham Fire Department and Gorham Ambulance responded to Voak and Oswald for a report of a pickup that rolled over with one subject still in the vehicle. The truck needed to be towed from the scene. The slippery conditions seem to be mostly in the northern part of Yates County. Nothing that could not be solved by reducing speed and having a good set of tires.
Himrod man charged with harassment
12/8/2011 HIMROD - Yates County Sheriff’s Deputies arrested Daniel J. Smith, 24, of 729 South Street, Himrod with criminal obstruction of breathing and 2nd degree harassment after a domestic dispute in which he was alleged to have pushed an individual down onto a bed and choked that person. Mr. Smith was arraigned in the town of Milo court and released to answer the charges at a later date.
Rochester man injured on Voak Rd. MVA
12/9/2011 VOAK - At about 8:30am the Yates County 911 Center dispatched the Gorham Fire Department and the Gorham Ambulance to Voak and Oswald Rd. for a report of a truck in the ditch. It was reported that Timothy J. Perkins, 57, of Rochester was traveling south on Voak Rd and had to avoid a southbound vehicle in his lane. His truck exited the west side of the road and struck the ditch. He was transported to F.F. Thompson Hospital for treatment of a back injury.
Rt. 247 accident injures Penn Yan women
12/9/2011 POTTER - At about 7:45am the Yates County Sheriff’s Deputies responded to a two car MVA on State Rt. 247 and Dunton Rd. in the town of Potter. An investigation reveled that Tamra M. Scott was driving northbound on 247 when Matthew J. Robinson, 22, of Middlesex, eastbound on Dunton Rd., failed to stop at the stop sign. Robinson’s vehicle struck Scott’s vehicle causing it to crash into the ditch. Robinson’s vehicle came to a rest in the intersection. Middlesex Ambulance transported Scott to Soldier’s & Sailors Hospital for treatment of head and back pain. Robinson was charged with failing to stop at a stop sign. The Middlesex and Rushville fire departments assisted at the scene.
Dresden man charged with harassment
12/8/2011 DRESDEN - The Yates County Sheriff’s Office received a report of a domestic incident on Long Point Rd. in the town of Torrey. Following an investigation Gary E. Boggio, 37, of Dresden was arrested and charged with criminal obstruction of breathing and 2nd degree harassment. He was arraigned before justice Grace in the town of Benton court and held on bail of $500 of $1,000 bond. He will appear in the town of Torrey court on December 13th to answer the charge.

Rochester man charged with failing to collect occupancy tax
12/9/2011 - Yates County Sheriff’s Sgt. Ed. Nemitz issued a criminal summons to Robert B. Foley, 53, of Larkwood Ave., Rochester directing him to appear in the village of Penn Yan Court to answer the charge of violating the Yates County Occupancy Tax Law. It is alleged that Mr. Foley failed to file a registration certificate requested by the county treasurer and willfully failed or refused to collect any tax imposed by such law from the occupant(s).
No brake lights get PY man his second DWI
12/10/2011 - Penn Yan Police arrested Joseph M. Freeland, 25, of Penn Yan at about 4:00am Saturday morning after a traffic stop in the village. Freeland was stopped on East Main Street after his vehicle was observed southbound with a brake light out. He was observed with bloodshot, glassy eyes, impaired speech and he had an odor of an alcoholic beverage on his person. Freeland was placed through several standardized field sobriety test which he failed. He was then arrested and taken to the Yates County Jail where a chemical test showed a BAC of .10%. He was issued tickets for inadequate brake lights, operating without insurance, operating in violation of restrictions and misdemeanor DWI .08% or more. He was also charged with felony aggravated unlicensed operation 1st degree due to the DWI charge while his license is currently suspended for a pending DWI arrest in the town of Benton. He was arraigned in the village of Penn Yan court and remanded to the Yates County Jail without bail due to two previous felony convictions. Freeland will appear in Yates County criminal court at a later date for a felony arraignment. Earlier on October 29th, 2011 Mr. Freeland was stopped by Yates County Sheriff Deputies on Rt. 364 in the town of Benton when again, his brake light were not working. He was charged at that time with DWI and speeding.

Roll over MVA, John Green
12/13/2011 - At about 5:30pm the Yates County Sheriffs department responded to a reported roll over motor vehicle accident on John Green Rd. north of Ellis Rd. There were as many as five occupants who did manage to get out of the vehicle. Both ambulances out of Dundee responded to the scene. More on the accident as reports are given.
Missing Italy teen has been located

Update - Per Lt. Tod Sotir, “Our officers followed up today (12/14) which included interviews of the family. It was learned that Brielle has contacted her family indicating that she is fine but at this time was not willing to give her whereabouts. We will continue to look for her
until we can personally speak to her.”

Traffic stop leads to drug arrest
12/13/2011 - Penn Yan Police charged Tamahara A. Hansen, 27, of Ogden Street with criminal possession of a controlled substance 7th, aggravated unlicensed operation of a vehicle 3rd, and operating without a license. Hansen was stopped on Lake Street in the village after she was observed driving without a license. While taking her into custody for the traffic offenses officers located a small amount of crushed up Hydrocodone in her possession. She was issued several tickets and released.
Travis charged for parole violation
12/13/2011 - Penn Yan Police charged Antony J. Travis, 48, of 3 East Main Street with violating the terms of his parole. Travis was picked up with the assistance of NY State Parole and remanded to the Yates County jail to await arraignment in front of Judge Patrick Falvey.
Gilbert Street man charged with choking resident
12/13/2011 - Yates County Sheriff’s Dept. received a report of a domestic involving residents at 23 Gilbert Street in the village of Rushville. Following an investigation of Deputy Killen and NY State Trooper Will, James R. Casillo, 46, of 23 Gilbert Street was charged with criminal obstruction of breathing and 2nd degree harassment. He was arraigned before tow of Potter Justice Bootes and held on bail of $250 or $500 bond.
Yates County being sued by family of jail suicide victim
12/15/2011 - The Finger Lakes Times has reported that the parents of a teenager who killed himself at the Yates County Jail last year are suing Yates County, Sheriff Ron Spike and several Yates County Correction Officers who were on duty when the teen hung himself. The suit was filed earlier this month in Thompkins County.
A corrections officer making routine rounds at the jail found Aaron J. Shehu with his bed sheet tied to the bars of the cell and around his neck, Yates County Sheriff’s deputies reported. The 17 year old was committed to the Yates County Jail on May 18. 2010. He was charged with grand larceny and criminal mischief involving three stolen cars. Shehu was arraigned by Justice John Symonds and bail was set at $10,000 cash/$20,000 bond.
An automatic investigation is done by the NY State Dept. of Corrections who did contact the sheriff soon after the incident. It is not yet know the results of that report. Sheriff Spike did state that Mr. Shehu showed no signs of mental problems or suicidal tendencies. It was noted at the time (November 2010) that Shehu was in a block of cells meant for inmates under the age of 21. Regardless of what block he was held in there are mandatory checks on inmates every 30 minutes. An investigation was done by the sheriff’s criminal investigation unit. Per an earlier report an officer stated that he/she talked to Mr. Shehu at 11:30.

Improper patient care cited in Yates County Jail suicide
12/16/2010 - Through the freedom of information act The Yates County Gazette received a final report of the NY State Dept. of Corrections regarding the investigation of the suicide of Andrew Shehu while an inmate of the Yates County jail. A great amount of the document was redacted due to personal and or medical information.
In the report it states that the medical review board investigated all related documents available and then reported to the NY State Commission of Corrections regarding the death of Aaron Shehu, who died November 27th, 2010 while an inmate of the Yates County Jail. It is well known that Mr. Shehu was discovered hanging from a sheet by a corrections officer while conducting regular rounds. The document also states that several suicide notes were found in his cell that were addressed to specific individuals.
The document list many dates where Yates County jail personnel did in fact receive information where Mr. Shehu was suicidal. On his first arrival it was noted by a NY State Police officer, verbally and written, that he should be watched closely. Per all written information, and the commission’s report, it appears that he was properly supervised while incarcerated within the Yates County Jail up until his return from Soldiers & Sailors Memorial Hospital in July of 2010.
Understanding the background, Mr. Shehu was labeled, maybe not officially, as border line mentally retarded and since January of 2010 he was a resident of Freedom Village in Lakemont, NY, a private faith program for at risk youth. His parents made it clear to Freedom Village officials that he was suicidal. While there it was alleged that he left notes of a morbid tone and was spoken to several times regarding those notes and intentions. After a second chance of stopping the attempts and talk of suicide he was remitted back to the custody of his parents.
On May 17th 2010 he allegedly stole two vehicles to return to Freedom Village and threatened a fellow peer who reported his suicidal tendencies. He was then committed to the Yates County Jail and it was recommended by the transporting NY State Police Officer that he be placed under constant supervision.
Per a report from the Chronicle Express, Sheriff Spike was quoted as saying, "We had no indicators that he had any plans." However, per the report of the NY State Department of Corrections there was written documentation from many agencies stating that Mr. Shehu was and had been suicidal for a number of years. Statements received by DOC investigators by corrections officers clearly state that many of the officers were concerned, and in fact nearby cell mates relayed information to corrections officers that they were concerned that Mr. Shehu would attempt suicide.
Per the commission’s report, “Had he (Mr. Shehu) received adequate and appropriate mental health evaluation, treatment and case management from Soldiers & Sailors Memorial Hospital, John Kelly Behavioral Health Services, both hospital and jail based, his suicide may have been prevented.”
The discharge back to jail was a violation of accepted NY State Hospital Code, “where only NY State licensed physicians may discharge patients.” The social worker (A.T) practiced outside her scope of activity. Per the report, the Soldiers & Sailors Hospital Emergency Department may be in violation of EMTALA, where inpatient hospitalization had been initiated, then improperly aborted.
Per the jail’s written log of July 6, 2010, Shehu was taken off constant supervision by the nurse. The RN’s “....unilateral action to discontinue constant supervision on a patient who’s plan only hours earlier had been inpatient psychiatric hospitalization.....represents flagrantly incompetent care.”
It is in fact sad to see any youth in jail. Mr. Shehu’s seventeen years seemed to have been troubled by a lack of where to go for help and a lack of someone to care enough to help him along the way. In at least the opinion of the NY State Department of Corrections, his suicide could have been prevented if he was not taken off constant monitoring and left in the inpatient hospitalization program.
The Shehu family is currently suing Yates County, Sheriff Ron Spike and several Yates County corrections officers who were on duty when the teen hung himself. The suit was filed earlier this month in Thompkins County. From all discovered documentation it appears that the jail staff, aside from not being able to find the emergency fire key, initially did it’s job. A majority of the blame is being put on the mental health care provided by the jail nurse, the assigned social worker, Soldiers & Sailors Hospital and John Kelly Behavioral Health Services.
Slippery roads cause three accidents - Dec 17th
8:15am - #1 Yates County 911 Center dispatched the Dresden Fire Department, PY ambulance to State Rt 14 for a reported roll over motor vehicle accident. It was reported that there was one occupant who did manage to get out of the vehicle. The vehicle was reportedly smoking. Upon arrival fire personnel stated that one male was placed in a personal vehicle to keep warm.
8:25am - #2 A second accident was reported at Dundee Lakemont Rd. in front of the VFW. A one car motor vehicle roll over accident with confirmed entrapment. By 8:40 the occupant was removed by fire personnel. Medic 55 responded from the previous accident in Dresden.
10:40am - #3 Middlesex and Rushville were called to respond to 4700 Middle Rd, near Lake to Lake Rd. for a two car motor vehicle accident where one car rolled over. The occupants of one car, one adult and one child were reported trapped. Ontario County responded with ALS and a second ambulance was requested from Middlesex. . Mercy Flight was placed on standby. Firemen shut down the road to safely take care of the scene. Mercy Flight took one patient to Strong Memorial Hospital.
Sheriff’s Department announces snowmobile safety course
12/17/2011 - Sgt. Edwin Nemitz of the Yates County Sheriff’s Department states that an 8-hour snowmobile safety course will be held on Friday and Saturday January 6th and 7th at the Sheriff’s office at 227 Main Street in Penn Yan.
All operators of a snowmobile ages 10 - 18 must have a snowmobile safety certificate to operate a snowmobile off their own property or to cross public highways. Adults may also take this course. The course is free to the public and both sessions must be attended. Class size is limited to 25 people.
Reservations can be made by calling 315-536-5178 Monday - Friday between 9am and 5pm. Reservations must be received by no later than January 6th.
Rushville and Middlesex FD respond to Middle Rd MVA
12/17/2011 - At about 10:35 on Middle Rd. near Lake to Lake Rd. in the town of Gorham, Sara Metcalf, age 20, of Canandaigua NY, Sharon Barone, age 66, of Naples NY and Tammy Walker, age 38, also of Naples NY were involved in a two car personal injury motor vehicle accident. A 2002 sedan operated by Miss Metcalf was northbound on Middle Rd. and started to make left turn, striking a 2001 Toyota pick-up operated by Mrs. Barone as Barone attempted to pass it on the left. Members of Rushville and Middlesex Fire Depts. and Middlesex Valley Ambulance responded to the scene. Mrs. Barone and Miss Walker who was a rear seat passenger in Barone’s truck were transported by Middlesex Valley Ambulance to FF Thompson Hospital for check overs. Ms. Tammy Walker who was a front seat passenger in Barone’s truck was transported by Mercy Flight Helicopter to Strong Memorial Hospital for lower back pain. Miss Metcalf was uninjured. Deputies state that the cause of the accident was an improper left turn, failure to signal on the part of Miss Metcalf, who was ticketed for same.

Unwanted communications tower on Shay Road
12/20/2011 - The town of Italy board held an emergency meeting outdoors at the site of a proposed new Ontario County emergency radio communications tower. At that meeting the board passed a resolution for a stop work order, while trucks were currently arriving with the parts for the tower. Italy town supervisor Brad Jones requested the Yates County Sheriff's Office to enforce the stop work order, but according to the Yates County Sheriff that order can not be enforced without a court order. The town and county are said to be in court over the matter and Yates County Supreme Court Justice W. Patrick Falvey has not yet ruled. Town officials state that Ontario County has ignored town zoning laws and not received approval to construct the tower, which if constructed would be within 1,800 feet from an existing tower on Parrish Hill Rd.
In the manner of an old west sign posted on the nearest tree, town of Italy supervisor’s special board meeting notice dated December 19th states that the town of Italy regulates the siting and construction of communications towers and requires a site plan review and a special use permit. Ontario county has “consistently and illegally refused to abide by our zoning law.” The site, at 3835 Shay Rd. is located within a few hundred feet of a currently occupied structure and within 100 feet from Shay Rd. itself. As of Tuesday morning there were no work crews on site and only a neighbor across the road who inquired what was going on after returning home from an extended period in Prattsburg. The sign gives the phone number for John W. Park, the Ontario County Attorney.
Ontario County has hired Florida based Communications International, Inc for part of their $17 million dollar project public safety project, which includes replacing the 400 MHz wide band with a 700MHz narrowband frequency. Communications Incorporated is to build 16 shelter sites throughout Ontario County with microwave dishes installed on the towers. Rochester's Harris Communication was awarded $9 million to supply the radio equipment necessary.
Per Yates County officials the tower could eventually save Yates County some money now paid to Ontario County for space rented off their tower. The planning and setting of tower sites during the planning stage must have included a project description and signed lease agreements with land owners. The area itself borders state land and an occupied structure. As of Wednesday morning there has been no decision from the Yates County Supreme Court.
Addison man arrested after leading PA Troopers on chase into NY
A domestic incident that originated in Lawrenceville, Pa. at about 9:30 A.M. on today’s date, resulted in a high speed pursuit by Pennsylvania authorities into New York, and an armed standoff that lasted approximately 4 hours. Raymond L. Enderle, age 57, of #614 Ct. Rt. #85, Addison, N.Y., was involved in a domestic incident at a residence in Lawrenceville, that involved the discharge of a handgun. Pennsylvania State Police, in conjunction with other Pennsylvania authorities, pursued Enderle to his residence on Ct. Rt. #85 in the Town of Tuscarora, where he barricaded himself inside. Members of the New York State Police, including Crisis Negotiators and Members of the Special Operations Response Team (S.O.R.T) responded to the scene and commenced negotiations. After a dialogue lasting approximately 4 hours, Enderle surrendered without incident.
As a result of facing multiple charges in Pennsylvania, Enderle was charged in New York as a Fugitive From Justice; arraigned in the Town of Lindley Court; and remanded to the Steuben Co. Jail pending extradition proceedings. Pennsylvania charges include Burglary, Criminal Attempted Burglary; Terroristic Threats with Intent to Terrorize Another; Unlawful Restraint; Recklessly Endangering Another; Fleeing/Attempting to Elude and Officer; Harassment; and Criminal Mischief to Property.
East Elm Street man charged with menacing
12/18/2011 - Penn Yan Police arrested Brian L. Gray, 27, of East Elm Street for several charges while investigating a vehicle and traffic incident that occurred on East Main Street. At some point during the investigation Mr. Gray tried to pull out a pocket knife and then attempted to prevent officers from taking him into custody. Gray later caused damage to the interview room of the police department. A loaded .22 caliber rifle and a bag of marijuana was found in his vehicle. He was arrested and charged with disorderly conduct, resisting arrest, attempted menacing of a police officer, criminal mischief unlawful possession of marijuana and possession of a (loaded) rifle in a motor vehicle. Gray was arraigned in village court and committed to the Yates County Jail on $3,000 bail or $6,000 bond.
Comstock Rd. man arrested on warrant
12/20/2011 - Steven J. Wedge was arrested on a bench warrant after failing to appear in the Penn Yan village court for the charges of disorderly conduct and obstructing governmental administration. Wedge was remanded to the Yates County jail on $500 cash bail or $1,000 bond.

Hammondsport man charged with second DWI
12/22/2011 - Gary E Drum, 30 of Hammondsport, was arrested by Penn Yan Police early Thursday morning after a traffic stop. Drum was observed speeding southbound on Lake Street leaving the village. His vehicle was clocked on radar at 46mph in a 30mph zone. Once being pursued by village police, Drum ignored the emergency lights and siren for nearly a mile before stopping about 1.5 miles from the village. He was observed with bloodshot, glassy eyes, impaired motor coordination, slurred slow speech and the odor of alcohol was emanating from his person. Drum was placed through several field sobriety test which he did fail. He was [laced under arrest for DWI and transported to the Yates County Jail where a chemical test showed his BAC to be .18%. Drum did have a previous DWI conviction in the village of Dansville in 2006, making the current DWI a felony. He was charged with speeding, felony DWI and aggravated felony DWI. He was arraigned in Penn Yan village court and released.
Suspect spits at PD officers
12/21/2011 - Village Police arrested Andrew T. Woodard, 22, of McKinley Ave. Apartments, Penn Yan for endangering the welfare of a child and three counts of 2nd degree harassment stemming from a domestic incident at his residence. Woodard is accused of pushing his girlfriend into their two year old daughter who was standing nearby. While police were interviewing both parties, Woodard made comments to hurt himself. He was arrested under the mental health law and taken to Soldier’s & Sailors Hospital. While at the hospital he struggled with officers and staff where he spat in the face of two officers. Woodard was arraigned in Milo town court and remanded to the Yates County Jail on $1,000 cash bail or $2,000 bond.

12/21/2011 - Angel-Shirley M. Albro, 29, of Dundee was arrested by PYPD Wednesday evening after a traffic stop in the village. The patrol unit LPR system hit on her vehicle for having a suspended registration. She was cited for no registration and operating without insurance. Albro will appear in the Penn Yan village court at a later date.
Dresden man charged with DWI
12/23/2011 - Joseph E. Gibson, 34, of 57 Cornelia Street, Dresden was stopped for inadequate lights on State Rt. 54 in the town of Benton. An odor of alcoholic beverage was detected and he was placed through a series of field sobriety test. He was transported to the Yates County Public Safety Building for a chemical test and released with tickets for inadequate lights common law DWI and DWI .08 or greater. Mr. Gibson will appear in the town of Benton Court at a later date.
Dundee man test .18% at DWI, UPM charge
12/22/2011 - Yates County Sheriff’s Deputies Emerson and Crofoot stopped Daniel E. Merritt, 30, of Gravel Run Rd., Dundee for a traffic infraction in the town of Milo. An odor of an alcoholic beverage was detected and he was placed through a series of field sobriety test. He was arrested and charged with DWI common law, aggravated DWI .08 or greater, failure to keep right, unlicensed operator, failure to signal and unlawful possession of marijuana. He was transported to the Yates County Public safety Building for a chemical test and then released with numerous ticket to reappear in the town of Milo court.
Larceny at the Dollar General
12/22/2011 - Penn Yan Police arrested Diane R. Young, 59, of Walnut Hill Apts., Penn Yan for petit larceny after a complaint from employees at the Dollar General in the Lake Street Plaza that Young was concealing merchandise in her hand bag. Young was found to be in possession of $150.24 worth of merchandise that she did not pay for. She was issued an appearance ticket for village court and released.
Noisy tenant nabbed for skipping court
12 23/2011 - Gregory M. Shaut, 26, of Penn Yan was arrested early Friday morning bu village police after a noise complaint on East Elm Street. Officers made contact with the individuals at the residence and recognized Shaut, knowing that there was an active bench warrant from the Penn Yan village court for failure to pay a fine. Shaut was taken into custody and a marijuana smoking pipe was found on his person. He was arraigned in village court on the warrant and charged with unlawful possession of marijuana. He was remanded to the Yates County Jail on $211.15 bail

“The message is simple, Drive Sober or Get Pulled Over. Drinking alcohol and driving do not mix. If you plan to consume alcohol, you should also plan not to get behind the wheel of a vehicle", said Major Donald DePass, Troop D Commander.
Unfortunately millions of drivers on America’s highways still think they are invincible, and they choose to jeopardize their safety and the safety of others on our roads, he said.
“Don’t let your 2011 holiday season end in an arrest or worse, death", DePass said. Remember, whether you’ve had way too many or just one too many, it’s not worth the risk.”
In December 2009, there were 753 people killed nationwide in crashes that involved drivers with blood alcohol concentrations of .08% or higher.
The New York State Police recommend these simple tips for a safe holiday season:
■Plan a safe way home before the festivities begin;
■Before drinking, designate a sober driver and leave your car keys at home;
■If you’re impaired, use a taxi, call a sober friend or family member, or use public transportation.
■If you happen to see a drunk driver on the road, don’t hesitate to contact 911.
■And remember, Drive Sober Or Get Pulled Over. If you know someone who is about to drive or ride while impaired, take that person’s keys and help him or her make other arrangements to get home safely.
Branchport man get his second DWI
12/24/2011 - At about 1:00am Yates County Deputies responded to a two car motor vehicle accident on the Italy Friend Rd. in the town of Jerusalem. Involved in the accident was Michael J. Lusk, 26, of 5397 Highlands Dr., Branchport. An odor of an alcoholic beverage was detected coming from his breath and he was then placed through a series of field sobriety test. He was taken to the Yates County public safety building for a blood test. Mr. Lusk was taken to the town of Jerusalem Court then held in the Yates County Jail on bail due to a prior DWI conviction in 2006 in Ontario County.
Warrant arrest
12/23/2011 - Stephen H. McFall Jr, 36, of Dundee was arrested on a warrant issued by Yates County Family Court for a child support violation. Mr. McFall was arraigned in Dundee village court where he was released to appear in Family Court on January 3rd.
Bad check charge
12/23/2011 - Beth A Rumsey, 43, of Rock Stream was issued a criminal summons by the village of Dundee Court for a complaint of a bad check that was issued to Martin’s Sure Fine. Ms/ Rumsey will appear in the village of Dundee court at a later date.

12/24/2011 - We all know how it works by now. And it seems you can’t escape. It’s cheaper to keep you vehicle legally registered.
Two more stops include Nathan P. Garrett, 27 of Shortsville for a suspended license and no insurance and Derrick L. Labar, 27, of Himrod for a suspended registration with no insurance.

Touch and go pilot forgets the landing gear
12/24/2011 - At about 2:45pm the Yates County Sheriff’s Office was notified by an airport representative of an incident involving an aircraft. An investigation revealed that Joseph R. Steiner, 62, of Williamsville, NY made several touch and goes at the airport. During one touch and go Mr. Steiner stated that he neglected to put the landing gear down. Joseph Steiner and a passenger, Rachael J. Steiner, 18, also of Williamsville, were riding in a 1997 fixed wing, single engine aircraft when it skidded along the runway for about 200 yards and came to a stop. Neither passenger was injured, though the airplane did receive damage to the under belly, wings and the prop. The airplane was removed from the runway and stored at Seneca Flight.
In aviation a touch-and-go landing is a maneuver that is common when learning to fly a fixed wing airplane. It involves landing on a runway and taking off again without coming to a full stop. Usually the pilot then circles the airport in the landing pattern or the airport and repeats the maneuver. This allows many landings to be practiced in a short time. It can also describe a maneuver used to test questionable landing surfaces.
